"COMPENSATION MECHANISM FOR DESTROYED OR DAMAGED PROPERTY: PROBLEMS, CHALLENGES, AND WAYS TO IMPROVE"

The issue of receiving compensation for destroyed and/or damaged real estate remains one of the most pressing for the affected population. 

The NGO ‘’The Tenth of April‘’ conducted an analytical research within the Shevchenkivska and Pervomaiska communities of Mykolaiv region to analyse the practical application of the mechanism of compensation for owners of damaged/destroyed housing, identify the main problematic issues that people face when receiving compensation and find possible ways to solve such problems. 

The research consists of three parts:
The first part examines the legal and regulatory framework for the procedure for
obtaining compensation for destroyed or damaged real estate.
The second part analyzes how the compensation procedure works in practice on the
example of Pervomaiska and Shevchenkivska hromadas in the Mykolaiv region and
highlights the difficulties faced by the affected population.
The third part analyzes the practice of consideration of cases related to the
compensation procedure by the national courts of Ukraine.

The research was presented by the lawyers of the organisation during the meeting of the Protection Cluster in Mykolaiv region and at the meeting of the Technical Working Group on Housing, Land and Property. The results of this study will be used as a basis for further advocacy work to improve the compensation mechanism.
